These Terms of Service (“Terms”) govern your access to and use of BrightAssessment (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use BrightAssessment. By using the Service you represent that the information you provide is accurate and that you have the authority to enter into these Terms.
2. Your account
You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us promptly of any unauthorized access.
3. The Service
BrightAssessment provides an AI-powered career assessment and an associated resume builder. Outputs are generated by software and are intended as guidance, not as professional career, legal, financial, or medical advice. You are responsible for reviewing results before relying on them.
4. Payments
Paid features are sold as one-time purchases processed through Stripe. Prices are shown in checkout and may change at any time for future purchases. Taxes may apply based on your location.
5. Refunds
Because the Service delivers AI-generated outputs immediately on purchase, all sales are final unless required otherwise by applicable law. If you believe a charge was made in error, contact us via the in-app support link and we will review your case in good faith.
6. Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right.
- Submit content you do not have the right to share, including another person’s resume without permission.
- Attempt to disrupt, reverse-engineer, scrape, or circumvent security controls of the Service.
- Resell or redistribute the Service, or its outputs, in a way that competes with BrightAssessment.
7. Your content
You retain ownership of the content you submit (such as resume text and assessment answers). You grant us a worldwide, non-exclusive license to host, process, and display that content solely so that we can provide the Service to you. We may use anonymized and aggregated data to improve the product.
8. Our content
The BrightAssessment brand, website, software, scoring framework, and templates are owned by us and protected by intellectual property laws. You may use the outputs we generate for your personal job search.
9. Termination
You may delete your account at any time from account settings. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce any particular career outcome.
11. Limitation of liability
To the maximum extent permitted by law, BrightAssessment will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the claim, or one hundred U.S. dollars, whichever is greater.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the date at the top of this page and, for material changes, notify you by email or in-app message. Your continued use of the Service after an update means you accept the new Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which BrightAssessment is established, without regard to its conflict of laws principles. Any dispute will be brought in the competent courts of that jurisdiction, unless mandatory consumer-protection law in your country of residence provides otherwise.
